The rules and agreements governing use of the Recruitica platform

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Recruitica ("we", "us", "our") governing your access to and use of the Recruitica platform, including all related websites, applications, and services.
By creating an account or using our platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
We reserve the right to update these Terms. Material changes will be communicated via email or in-platform notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
2. Platform Description
Recruitica is a rec2rec (recruitment-to-recruitment) marketplace platform that connects recruitment professionals (recruiters) with recruitment agencies seeking talent. Our platform provides:
Important: Recruitica is a marketplace facilitator. We do not act as a recruitment agency, employer, or employment agent. We do not guarantee placements, employment, or specific outcomes from using the platform.

4. Recruiter Obligations
Profile Accuracy
You must ensure your recruiter profile accurately represents your professional experience, skills, specialisations, and current availability. Misleading or false profile information may result in account suspension.
Professional Conduct
You agree to conduct yourself professionally in all interactions on the platform, including communications with agencies, interviews, and any candidate-related activities. You must comply with all applicable employment laws, equality legislation, and industry codes of practice.
Non-Circumvention
Connections made through Recruitica must be honoured through the platform. You may not use information obtained via Recruitica to circumvent the platform and engage directly with agencies or candidates outside the agreed process for a period of 12 months following the introduction.
5. Agency Obligations
Accurate Job Listings
All job listings must accurately describe the role, compensation structure (base salary, commission, benefits), location, and requirements. Misleading listings that misrepresent commission structures, earning potential, or working conditions are prohibited.
Fair Recruitment Practices
Agencies must conduct fair and non-discriminatory recruitment processes. You must comply with the Equality Act 2010 (or equivalent legislation in your jurisdiction) and provide timely feedback to applicants.
Data Protection
Agencies receiving candidate data through the platform act as joint data controllers. You must process candidate data only for the purpose it was shared, maintain appropriate security measures, and comply with GDPR obligations. You must not share candidate data received through Recruitica with third parties without explicit consent.
6. Candidate Data Rules
Mandatory Consent Requirement: Recruiters must obtain explicit consent from candidates before uploading their personal data (CV, contact details, work history) to Recruitica. Uploading candidate data without consent is a violation of these Terms, GDPR, and may result in immediate account termination.
Candidate data may only be used for the specific recruitment purpose for which consent was given
You must not repurpose candidate data for other roles, agencies, or marketing without fresh consent
You must inform candidates of their data subject rights and how to exercise them
Candidate data must be kept accurate and up to date; outdated data must be removed
Upon request from a candidate, their data must be deleted from the platform within 30 days
Recruitica provides consent management tools within the platform. Users who violate these candidate data rules face account suspension or termination and may be required to indemnify Recruitica for any resulting regulatory fines or legal costs.

9. Intellectual Property
The Recruitica platform, including its design, code, algorithms, branding, and content (excluding user-generated content), is owned by Recruitica and protected by intellectual property laws.
Your Content
You retain ownership of content you upload (profiles, CVs, job listings). By uploading, you grant Recruitica a non-exclusive, worldwide licence to use, display, and process this content as necessary to provide our services.
Platform Content
You may not copy, modify, distribute, or create derivative works from our platform or its content without written permission. This includes our matching algorithms, analytics tools, and design elements.
10. Liability & Disclaimers
Platform Provided "As Is"
The platform is provided on an "as is" and "as available" basis. While we strive for reliability, we do not guarantee uninterrupted or error-free service.
No Guarantee of Outcomes
We do not guarantee that you will find a placement, hire a recruiter, or achieve specific results. The quality of matches depends on information provided and market conditions.
Limitation of Liability
To the maximum extent permitted by law, Recruitica's total liability for any claim arising from your use of the platform shall not exceed the fees paid by you in the 12 months preceding the claim. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
User Verification
While we conduct basic vetting on agency accounts, we do not guarantee the accuracy of user profiles, credentials, or representations. Agencies are responsible for conducting their own due diligence on recruiters, including reference checks, right-to-work verification, and professional qualification checks.
11. Termination
Termination by You
You may close your account at any time through your account settings or by contacting support. Outstanding obligations (fees, placement agreements) survive termination.
Termination by Us
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or pose a risk to other users. For non-material breaches, we will provide 14 days' notice and an opportunity to remedy.
Effect of Termination
Upon termination, your right to access the platform ceases. We will retain your data as described in our Privacy Policy and delete personal data within 30 days of account closure, except where retention is required by law or necessary for ongoing obligations.
